Trademark protection

Luigi 1884 Fonds e.V. points out that the exclusivity of its various logos and registered trademarks is legally protected in order to ensure that these logos and registered trademarks are used in accordance with the legal regulations and provisions and to ensure they are only used by third parties when granted exclusive rights of use.

 

The use of word-image trademarks, word trademarks and the original figure are Luigi 1884 Fonds e.V.’s most important assets from which revenue is derived in accordance with the articles of association.

 

Luigi 1884 Fonds e.V. is aware of the value of its trademarks for its own interest and the interest of its field of activity and is therefore particularly active in controlling the use of its rights and the services and products offered, both physical and digital. The internet and the most important marketplaces in this field are therefore constantly monitored in order to protect the rights of Luigi 1884 Fonds e.V. and in particular to prevent the sale of non-original products by unauthorised third parties.

 

Selling or advertising non-original or unlicensed items is a criminal offense or breach of contract which will be prosecuted and punished under the applicable laws. Luigi 1884 Fonds e.V. works together with its partners to combat counterfeiting on a daily basis. Together with its legal partners, Luigi 1884 Fonds e.V. has therefore also activated a special channel for the police to immediately check articles that are at risk of being counterfeited.

 

In order to avoid the distribution of non-original material, we ask that you only buy official products.

 

We would be very grateful for any information about supposedly counterfeited material. According to general criteria, a trademark infringement has occurred if all of the following three points apply:

  • A company is using a trademark (or a similar trademark) of Luigi 1884 Fonds e.V. without the right to use it.
  • The company is using this trademark (or a similar trademark) for commercial purposes.
  • This use violates the powers of Luigi 1884 Fonds e.V. arising from its trademark and/or is likely to cause confusion in commercial transactions.
